These Terms of Use ("Terms") govern your access to and use of Aira (the "App") and related services (together, the "Services"), operated by Aira Match Ltd ("we", "us", "our"). By creating an account, accessing the App, or using any part of the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

1. Eligibility

1.1 You must be at least 18 years old to use the Services.

1.2 You represent and warrant that you meet the age requirement and that all information provided to us is accurate, current, and complete.

1.3 We reserve the right to suspend or terminate accounts if we have reason to believe you do not meet eligibility requirements.

2. Account Registration

2.1 You may create a free account to:

• create a profile
• view overall match compatibility
• receive messages from paid subscribers and reply to them

2.2 Certain features, including initiating conversations and other app functionalities, require a paid subscription.

2.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

2.4 You must notify us immediately if you suspect unauthorized use of your account.

3. User Conduct

By using the Services, you agree not to:

• impersonate others or misrepresent your identity
• harass, threaten, or abuse other users
• post content that is illegal, offensive, or sexually explicit beyond what is reasonably permitted in a dating context
• solicit money or commercial services outside of the App’s functionality
• attempt to circumvent subscription payments or security measures
• engage in fraudulent or abusive behaviour

We reserve the right to investigate violations and to suspend or terminate accounts at our discretion.

4. Subscription Services

4.1 Paid subscriptions provide access to premium features, including the ability to initiate messages, access enhanced visibility, and use additional app functionality.

4.2 All subscriptions are recurring, billed in advance according to the plan you select.

4.3 You agree to provide accurate billing information and to pay all fees associated with your subscription.

4.4 Refunds, chargebacks, and disputes are governed by our Refund and Chargeback Policy (Section 8).

4.5 We reserve the right to suspend or terminate accounts engaged in fraudulent or high-risk activity related to subscriptions, including abuse of free messaging or chargeback manipulation.

5. Payment Processing and High-Risk Merchant Policy

5.1 All payments are processed by PCI-DSS-compliant third-party payment processors.

5.2 We may share limited transaction, account, and behavioural data with processors, card networks, and banks to prevent fraud, enforce these Terms, and defend against chargebacks.

5.3 Dating services are considered high-risk by card schemes. Users acknowledge that subscriptions may be subject to verification and risk assessment.

6. Content Ownership and Licenses

6.1 You retain ownership of content you submit (photos, messages, prompts) but grant us a worldwide, royalty-free, non-exclusive license to:

• display your content to other users
• provide and improve the Services
• comply with legal obligations

6.2 You are responsible for all content you share. You represent that you have the rights to post the content and that it does not violate these Terms or applicable law.

6.3 We reserve the right to remove or restrict content that violates these Terms.

7. Safety and Moderation

The App includes moderation and safety measures to protect users, including:

• automated screening of messages and profiles
• human review of flagged content
• reporting mechanisms for harassment or fraud

7.2 We may suspend, restrict, or terminate accounts to protect users or enforce policies.

7.3 Users must report abusive or unsafe behaviour. We do not assume responsibility for interactions between users.

8. Refunds, Chargebacks, and Disputes

8.1 Paid subscriptions are recurring and non-refundable, except as required by law or at our discretion.

8.2 Users may not initiate chargebacks or disputes in bad faith. Fraudulent chargebacks will result in account termination and potential legal action.

8.3 We retain all transaction and message records to defend against disputes and to comply with regulatory requirements.

8.4 By subscribing, you acknowledge that subscription services are delivered immediately and cannot be “returned” in the traditional sense.

9. Privacy and Data Protection

9.1 Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data, including special category data such as sexual orientation.

9.2 We may process data for providing free and paid features, fraud prevention, chargeback defence, safety, and legal and regulatory compliance.

10. Prohibited Automated Activity

10.1 You may not use bots, scrapers, or other automated systems to interact with the App.

10.2 Automated behaviour that circumvents subscription restrictions, messaging limitations, or moderation measures is prohibited and may result in account termination.

11. Intellectual Property

11.1 All App content, logos, designs, software, and trademarks are owned by us or our licensors.

11.2 Users are granted a limited, non-exclusive, non-transferable license to access and use the App for personal purposes.

11.3 You may not reproduce, distribute, reverse engineer, or commercially exploit App content without prior written permission.

12. Liability and Disclaimers

12.1 The Services are provided “as is”.

12.2 We do not guarantee matches, communications, or compatibility results, uninterrupted or error-free service, or security of user interactions beyond reasonable technical measures.

12.3 You use the Services at your own risk. We are not responsible for user interactions, content, or external links.

12.4 Our liability is limited to the maximum extent permitted by law.

13. Termination

13.1 We may suspend or terminate accounts for:

• violation of these Terms
• fraudulent or abusive activity
• safety or regulatory reasons

13.2 Users may cancel paid subscriptions at any time via the App or their app-store account. Termination of free accounts will result in loss of access to content and messages.

14. Governing Law and Dispute Resolution

14.1 These Terms are governed by the laws of England and Wales.

14.2 Disputes will be submitted to courts of England and Wales, unless an alternative method (e.g., arbitration) is mutually agreed.

15. Changes to These Terms

15.1 We may update these Terms to reflect changes to the Services, legal requirements, or business practices.

15.2 Material changes will be communicated via the App or email. Continued use constitutes acceptance of the updated Terms.
